UK: spam offers help to claim compensation for "police misconduct."

There's been much criticism of businesses that make their money from so-called claims management.

From cold calling hoping to find those who have been in accidents to the obscene profits made by companies "managing" financial services mis-selling, even though the industry made it easy to make claims without assistance.

Today, a spam has arrived offering to help with a claim against the police, capitalising on recent bad press.

"A new report into policing in the UK has shown that there were a staggering
67,732 complaints raised against police forces in 2020/21.

So says the spam from "claimsexperts.co.uk" which it says is the trading name of Fairweather Claims Ltd who are a Claims Management company."

But the spam contains a lie. It says "You are receiving this message because you have given the authorization for the processing of your personal data and to receive commercial communication, or because you have participated in an event organized or connected to Enviando UG.

The recipient says that he has never knowingly or willingly provided his address to that company for the stated purposes or at all.

The mail originates from a spam-mailing service: emailforyou.co.uk.

That's the website. Aside from showing a girl in a dress as the product for "Men's Shirt", the content on the site is only lorem ipsum text.

The mail-out site was registered in Germany on 18th January and is hosted on Amazon web services. The domain owner is not revealed in a search but it does contain this statement "Nominet was able to match the registrant's name and address against a 3rd party data source on 29-Oct-2020"

Nominet is the registry for all .uk addresses.

Claimsexpert.co.uk.com is registered to an individual and has been since 2013. It shows no specific link to Fairweather Claims Ltd and he is not listed in the "our team" page.

The spam says that the company is regulated by The Financial Conduct Authority under reference number 935899. That is true and the trading name, with others, is listed.

The Financial Conduct Authority registration has been valid since 2020 and authorises, inter alia "Seeking out, referrals and identification of claims or potential claims (personal injury claim; financial services or financial product claim; housing disrepair claim; claim for a specified benefit; criminal injury claim; employment related claim)"

So, provided the methods are legal, soliciting business is specifically permitted under the authorisation.

Businesses of this type have often offered "free" services but that is paid for by a percentage of any moneys recovered on a no-win, no-fee basis which stretches the meaning of "free." These percentages, when added to legal fees when lawyers are instructed, can become a very substantial proportion of any amount obtained.

That may or may not be the case here but the fact that this has been a common practice means that prospective users of the service should be extremely cautious.
